Terms and Conditions – Elevate

This document governs the use of the Elevate website and services and is binding upon every user who accesses, interacts with, registers, or places an order through our platform. It is written in masculine form for convenience only but applies equally to all genders. Use of the website constitutes agreement to all terms described herein. Please read carefully. If you do not agree, you are requested not to use or register on the site.

The website includes an online shop offering the ability to purchase various products, and the terms of use herein apply to all use or purchasing activities. Elevate serves as an intermediary between third-party suppliers—manufacturers, wholesale sellers, and global factories—and the customers purchasing through the site. Purchases made through the site are considered for personal, non-commercial use only and constitute a direct import to the customer.

All services provided through the website, including design, content, branding, trademarks, systems, and algorithms, are protected by intellectual property law and may not be copied, distributed, published, or reused in any form without explicit written permission. Any attempt to duplicate or repurpose site content or infrastructure is strictly prohibited.

Use of this site or placing an order constitutes your agreement that you will not have any complaint or demand against Elevate or its team. The terms described here are the sole rules binding on Elevate and its site operators. Terms may be updated without notice at any time at the full discretion of Elevate. Changes will apply only to transactions initiated after their publication.

Jurisdiction

The sole jurisdiction for any dispute arising from use of this website shall be the appropriate courts within the European Union territory relevant to the customer’s residency or the seller’s representation under Regulation (EU) No 1215/2012.

User Eligibility

Use of the site is restricted to persons 18 years and older who possess legal capacity. All personal information submitted must be accurate and up-to-date. Elevate is not responsible for loss resulting from compromised accounts or shared credentials. It is forbidden to open accounts on behalf of third parties without their explicit consent.

Technical Interruptions and Data Security

Elevate disclaims any liability for service interruptions, hosting outages, system failures, cyberattacks, or other incidents stemming from technical issues or malicious actors. Although we apply standard cybersecurity measures and encryption protocols, no platform can guarantee absolute immunity from security breaches.

Product Listings and Manufacturer Information

Product pages on our site are based on information provided by manufacturers or third-party partners. While we aim to verify accuracy, discrepancies may exist. Products may be presented with images or descriptions that differ slightly from actual packaging or configuration. This is especially relevant in international sourcing contexts.

Elevate is not the manufacturer of the products offered. Customers are advised to read packaging instructions carefully and seek professional guidance before using products involving medical or bodily application. The site content does not constitute medical advice, diagnosis, or treatment.

Pricing and Taxes

Product prices are listed inclusive of VAT unless otherwise noted. Prices may be modified at any time and the price charged is that displayed at the time of order confirmation. All orders are processed immediately after payment confirmation and therefore cannot be canceled unless confirmed by our team before shipment has begun.

Shipping and Delivery

Products are shipped directly from our partner warehouses in China. Orders are generally shipped within 1 to 5 business days after processing. Standard delivery ranges from 3 to 14 business days under typical conditions. However, due to customs processing, import inspection, or delays including but not limited to national holidays such as Chinese New Year, delivery may extend up to 40 business days.

In rare cases, multiple products in a single order may arrive in separate shipments due to supplier distribution logistics. Elevate assumes no responsibility for customs clearance delays or additional duties unless explicitly covered under an IOSS regime for eligible EU countries.

Order Confirmation and Fulfillment

Upon submitting your order, you will receive an automatic confirmation via email. Confirmation includes a summary of your purchase. If a product is unavailable or out of stock, Elevate reserves the right to cancel the order or suggest a suitable alternative. If no alternative is accepted, a full refund will be issued. Refund timing is subject to third-party payment processors and may take up to 45 business days in edge cases.

Returns and Right of Withdrawal

In compliance with EU Directive 2011/83, customers may cancel their purchase within 14 calendar days from receipt of goods, provided the product is unused, unopened, and in its original packaging with all accessories included. Elevate will deduct 5% of the transaction value or €25 (whichever is lower) as a cancellation fee, in accordance with cost recovery regulations.

Returned goods must be sent via trackable shipping service to our designated fulfillment center in China. Customers are responsible for return shipping unless the item is defective upon delivery. Returns must be coordinated with our support team via email or WhatsApp before dispatching. Unauthorized or uncoordinated returns may not be accepted.

Hygiene Products and Exceptions

Under Article 16(e) of Directive 2011/83/EU, hygiene-sensitive goods such as insoles, garments, intimate items, or any products that come into direct contact with the body may not be returned once opened, unless proven defective at arrival. Connecting such items to water, electricity, or bodily contact will be considered usage and disqualify the product from return eligibility.

Damaged or Defective Items

Products found defective upon arrival must be reported within 5 business days of receipt, including clear photo or video documentation. We may issue refunds, send replacement items, or offer partial credit depending on the case. Products damaged due to customer misuse, improper handling, or failure to follow usage instructions are not eligible for refunds or replacement.

Limitations of Liability

Elevate is not liable for losses due to incorrect address input, failed collection, or refusal by the customer to accept delivery. In such cases, items may be returned to sender and re-shipping fees will apply. We are not responsible for force majeure events, including but not limited to extreme weather, war, pandemic restrictions, customs detainment, labor strikes, server outages, or government actions affecting shipping or availability.
